The ITR due date for freelancers has passed and you have not filed. Maybe you were waiting for a client's TDS certificate, maybe you were unsure which form to use, or maybe the date simply slipped past you. Searching for it turns up mixed dates, because the due date for people with business or professional income is different from the one for salaried filers, and it changed this year.
If you missed the ITR deadline as a freelancer, you can still file a belated return, but it costs a late fee and interest on any unpaid tax. Here is the timeline for AY 2026-27 (income earned in FY 2025-26), what the penalty is, and what to do first. These dates are accurate as of mid-October 2026, so check the income tax portal for any later notice before you act.
The deadline for freelancers was 31 August 2026, and it has passed
For AY 2026-27, the Finance Act 2026 moved the due date for non-audit business and professional filers from 31 July to 31 August, while ITR-1 and ITR-2 filers stayed at 31 July (the Finance Bill 2026 memorandum explains the change). The portal's own FAQ describes the date as 31 July, or 31 August for non-audit cases, so a freelancer filing ITR-3 or ITR-4 without an audit was working to 31 August.
Audit cases had a different date. Circular No. 07/2026, dated 28 September 2026, extended the return date for the cases it covers from 31 October to 21 November 2026 (portal news). If your accounts need an audit, read the circular for your category. Everyone else who has not filed is now filing a belated return.
You can still file a belated return until 31 December 2026
Under Section 139(4) of the Income Tax Act, 1961, a belated return for AY 2026-27 may be furnished on or before 31 December 2026, or before the assessment is completed, whichever is earlier (Income Tax Department FAQ). AY 2026-27 returns are processed under the 1961 Act, which is why the section numbers in this post are the old ones, even though the Income-tax Act, 2025 now applies to later years.
File as early as you can. Every month of delay adds interest on unpaid tax, and the belated window ends on a fixed date.
The late fee is ₹1,000 or ₹5,000, plus interest on tax you still owe
Section 234F sets the fee for filing late at ₹1,000 where your total income does not exceed ₹5,00,000, and ₹5,000 in all other cases; for AY 2026-27 the 1961 Act's Section 234F applies (same Income Tax Department FAQ). If you were not required to file because your income was below the basic exemption limit, ask a CA whether any fee applies to you, because it can still arise where filing was compulsory for another reason.
Separately, Section 234A charges simple interest at 1 percent per month, or part of a month, on the tax that remained unpaid after the due date. Pay any tax you owe straight away, before you file, to stop that interest growing. The guide on setting aside tax every month as a freelancer shows how to avoid a surprise bill next year.
Get your documents first, then file the form you would have used
Download your Form 26AS and Annual Information Statement from the portal, and check that each client's TDS appears in them before you file. If a client's TDS certificate is missing, the guide on what to do when a client's Form 16A is missing explains how to chase it. For which form to use, see the guide on ITR-3 versus ITR-4 for freelancers, and for the step-by-step filing process the guide on filing ITR-4 as a freelancer.
If you already filed and found a mistake, you can revise
A revised return under Section 139(5) can be filed before the end of the assessment year, which is 31 March 2027 for AY 2026-27, or before the assessment is completed, whichever is earlier (same Income Tax Department FAQ). A fee under Section 234-I applies to revised returns filed late in that window, so check the amount and the starting date on the portal before you revise. Revising is for correcting a return you have already filed, not a substitute for filing one at all.
If you miss the belated window as well, the Act provides for an updated return under Section 139(8A). Check the portal for the time limit and the extra tax that applies before relying on it.
A revised or corrected return can also follow a message from the department. The guide on income tax notices and 143(1) intimations for freelancers explains what each one means and how long you have to respond.
Filing late can also affect your losses
Under Section 80, a loss can be carried forward only if the return was filed within the time allowed, so filing the original return late can cost you the right to carry forward business and capital losses. Some losses, such as a house property loss, are exceptions. If you have a loss to carry forward, confirm the position with a CA before relying on a late filing. Freelancers who pay tax under the presumptive scheme of Section 44ADA, where profit is taken as a fixed share of receipts, are less likely to be affected, but check your own case.
Check your year's receipts against your invoices before you file
Add up what you were paid and compare it with the invoices you raised before you file. Rinto lets you mark invoices paid, so you always know what you were paid and by whom when it is time to file. This post is general information, not tax advice, so confirm your own position with a CA. The guide on how freelance income is taxed in India explains the basics behind the numbers you report.
Frequently Asked Questions
What is the ITR due date for freelancers for AY 2026-27?
For non-audit business and professional filers, which includes most freelancers using ITR-3 or ITR-4, the due date for AY 2026-27 was 31 August 2026. The Finance Act 2026 moved it from 31 July, while ITR-1 and ITR-2 filers stayed at 31 July. Audit cases had a different date, which the Income Tax Department extended by Circular No. 07/2026. That date has passed, so anyone who has not filed is filing a belated return. Check the portal for any later notice before you act on these dates.
I missed the ITR deadline. Can I still file?
Yes. A belated return for AY 2026-27 may be filed under Section 139(4) on or before 31 December 2026, or before the assessment is completed, whichever is earlier. You will pay a late fee and interest on any unpaid tax, so file as soon as you can. Get your Form 26AS and Annual Information Statement first and check your clients' TDS appears in them, so the return is accurate the first time. Pay any tax you still owe first, because interest runs on it until you do.
What is the penalty for filing ITR late as a freelancer?
The late filing fee under Section 234F is ₹1,000 if your total income does not exceed ₹5,00,000 and ₹5,000 in all other cases. On top of that, Section 234A charges simple interest at 1 percent per month, or part of a month, on tax that remained unpaid after the due date. Paying any tax you owe before you file keeps the interest from growing. If your income was below the basic exemption limit, ask a CA whether any fee applies.
Can I revise my ITR after filing it?
Yes. A revised return under Section 139(5) can be filed before the end of the assessment year, 31 March 2027 for AY 2026-27, or before the assessment is completed, whichever is earlier. A fee under Section 234-I applies to revised returns filed late in that window, so check the amount and start date on the portal. Use it to correct something in a return you have already filed, such as a missing income entry or a wrong TDS figure. It does not replace filing a return on time, and it works only if an original return has been filed. If you have not filed at all, a belated return is the route to use.
Does filing late affect my refund or my losses?
Under Section 80, filing the original return after the due date can cost you the right to carry forward business and capital losses, with exceptions such as a house property loss, so confirm the position with a CA if you have a loss. Refund timing on a belated return is also worth checking with your CA. Freelancers taxed under the presumptive scheme of Section 44ADA are less likely to have losses to carry forward, but your own case may differ. Ask a CA before filing if you have losses, a refund due or other unusual items.
