A 17-year-old who designs logos well enough to be paid for them runs into a problem no portfolio fixes. The first client asks for a signed agreement, the second asks for a PAN and an invoice, and a platform asks for a date of birth. Being good at the work is not the barrier. The law treats people under 18 differently when it comes to contracts, accounts and tax, and most "start freelancing as a student" advice skips that.
In India you can do freelance work before 18, but a minor generally cannot make a binding contract, so the safer structure is for a parent or guardian to be involved. A parent applies for the PAN, banks offer minor accounts, major platforms set their own age rules, and a minor's income can be added to a parent's for tax unless it comes from the child's own skill. Here is how each piece works, what stays unclear, and what changes at 18.
A minor's contract is generally void, so the client cannot enforce it
Section 11 of the Indian Contract Act requires a party to be competent to contract, which includes having reached the age of majority, and that age is 18. In the Privy Council's 1903 decision in Mohori Bibee v Dharmodas Ghose, a minor's agreement was held void from the start. The practical effect for you is that a client cannot enforce a contract against you while you are under 18, and a careful client knows it.
That does not stop you doing the work, but it changes the paperwork. The safer structure is usually for a parent or guardian to be the contracting party with the client, so that the agreement binds an adult. Whether a guardian can sign validly on the minor's behalf is a point you should confirm with a lawyer for your case, because the law on this is not clear-cut. The guide to a freelance contract in India lists what the agreement should still say, and working without a contract shows the risk of skipping it.
A parent applies for a minor's PAN, and banks allow accounts at any age
For a PAN, a parent or guardian applies on Form 49A as the minor's representative, and NSDL's PAN instructions make that section mandatory for minors. Whether a minor needs a PAN to receive a payment varies by client and bank, so ask them what they require, and apply anyway if you are earning regularly.
On banking, an RBI circular of 21 April 2025 (RBI/2025-26/26) lets minors of any age open a savings account through a guardian, and minors aged 10 or above can operate one independently within limits their bank sets. Overdrafts are not allowed, and when you turn 18 the bank must collect fresh instructions and a specimen signature. Banks may offer debit cards and internet banking at their discretion. The broader question of a separate account is in the guide on a business bank account for freelancers, and UPI limits for minors differ by bank, so ask yours.
Fiverr, Upwork and Freelancer.com each set their own age rules
Fiverr requires users to be 18 or older, but allows ages 13 to 17 to use an account owned by a parent or guardian, with the parent's ID verified and earnings withdrawn through the parent. Freelancer.com's User Agreement (section 3) bars users under 16, and says a person over 15 but under 18 can use an adult's account with that adult's permission. Upwork says users must be 18 or the local age of majority, whichever is higher. Rules change, so read the current terms before you sign up.
Each of these routes needs an adult on the account. If you would rather skip platforms and find direct clients, the guide on building a freelance portfolio with no experience is the better starting point, and the pillar guide on how to start freelancing in India covers the rest.
A minor's income is added to a parent's, except income from the child's own skill
Section 64(1A) of the Income-tax Act adds a minor child's income to the income of the parent whose own income is higher. Income that comes from the child's manual work, or from skill, talent, specialised knowledge or experience, is not clubbed, according to the income tax department's page on clubbing. Freelance design, writing or coding income is likely to fall on the skill side, though interest on your savings is clubbed. A minor with a disability under Section 80U is outside the clubbing rule altogether.
There is also a relief of up to ₹1,500 per child where income is clubbed. Whether it applies under the new tax regime is disputed in secondary sources, so ask a CA. This describes the Income-tax Act 1961, which governs FY 2025-26 and AY 2026-27. The Income-tax Act 2025 applies from 1 April 2026 and carries the rule under a new section number, so check the current provision for income earned from FY 2026-27. Who files the return for a minor, and from what income, is another point to confirm with a CA. If you are 18 or older and in college, the rules in the guide on freelance tax in India apply to you like any other freelancer.
Keep every client agreement and payment in one place
Whoever signs, a clear record protects everyone. Rinto lets you keep notes and file attachments per client, so the signed agreement, the brief and the payment details for each client sit together, and you can mark invoices paid and always know who owes you what. It does not give legal advice or file taxes, so confirm the structure with a lawyer or CA. This post is general information, not legal or tax advice.
Frequently Asked Questions
Can I freelance in India if I am under 18?
You can do the work, but a contract signed by a minor is generally void, so a client cannot enforce it against you. The safer structure is for a parent or guardian to be the contracting party, and to confirm that setup with a lawyer for your case. Banks allow minor accounts through a guardian, and a parent applies for your PAN. Platforms set their own age rules, so check each one. Keep written records of the brief, the price and the payment, since they protect both you and the client.
Can a minor have a PAN card and a bank account?
Yes. A parent or guardian applies for the PAN on Form 49A as the minor's representative. On banking, an RBI circular of 21 April 2025 lets minors of any age open a savings account through a guardian, and minors aged 10 or above can operate one independently within limits their bank sets. Overdrafts are not allowed. When you turn 18, the bank collects fresh instructions and your specimen signature. Check your bank's own policy for debit cards and internet banking, since those are at its discretion.
Can I join Fiverr or Upwork under 18?
Not on your own. Fiverr requires users to be 18 or older, but allows ages 13 to 17 to use an account owned by a parent or guardian, with the parent's ID verified and earnings paid out through the parent. Upwork says users must be 18 or the local age of majority, whichever is higher. Freelancer.com's User Agreement bars users under 16 and lets those over 15 but under 18 use an adult's account with permission. Terms change, so read the current ones before signing up, and never lie about your age.
Is a minor's freelance income added to the parent's income for tax?
Under Section 64(1A), a minor's income is usually added to the income of the parent whose own income is higher. Income from the child's own manual work, or from skill, talent, specialised knowledge or experience, is not added, according to the income tax department. Interest on savings is added. A minor with a disability under Section 80U is outside the rule. This describes the 1961 Act, which governs FY 2025-26. The Income-tax Act 2025 applies from 1 April 2026 under a new section number, so confirm the details, including who files the return, with a CA.
What changes when I turn 18 as a freelancer?
You become competent to sign contracts yourself, so clients can enforce an agreement with you and you can enforce it against them. Your bank must obtain fresh operating instructions and your specimen signature, and you can open your own accounts on platforms that require adults. Move any agreements that a parent signed into your own name, tell your bank, and read the platform terms again at 18. If a client dealt with your parent until now, tell them in writing that you will deal with them directly from your birthday, and keep that message with the original agreement.
