You registered for GST because a client asked for a GSTIN, or because you crossed the threshold in a good year. Now the work has slowed, you took a full-time job, or your turnover sits well below the limit, and the monthly returns feel like a tax on doing nothing. Many freelancers keep filing for years because nobody told them registration can be closed, and others simply stop filing, which is the worst way to leave.
A registered freelancer can apply to cancel a GST registration voluntarily using Form REG-16 on the GST portal, within 30 days of the event that justifies it. After the officer's order, a final return in Form GSTR-10 is due. Here are the grounds, the steps, the final return, what happens to input tax credit on goods, and why simply stopping is a bad idea.
You can apply to cancel if you stopped, changed or no longer need to be registered
Section 29(1) of the CGST Act lets the officer cancel a registration on application by the registered person. The grounds include the business being discontinued or transferred, a change in the constitution of the business, and the person no longer being liable to register. The last ground matters most to freelancers: since 1 January 2021 the section also allows a person who registered voluntarily to opt out. The registration threshold for services is ₹20 lakh, or ₹10 lakh in special category states, as covered in the guide on when a freelancer must register for GST.
An older rule that stopped voluntary registrants from applying within a year of registering was later omitted, so there is no lock-in in the current rules. You also need a reason that fits: staying under the threshold, closing the practice, or moving into employment all qualify. Composition taxpayers are treated differently and file no final return, as the guide on the GST composition scheme for freelancers explains.
File REG-16 on the portal and the registration is suspended while the officer decides
The application is made electronically in Form REG-16 within 30 days of the event. CBIC Circular 69/43/2018-GST says the 30-day window can be read liberally where the event cannot be pinned to a day. The portal asks for the reason, the date from which you want cancellation, your contact details, the value and tax on any stock of inputs and capital goods, and the details of the last return you filed.
Once you apply, the registration is treated as suspended. You cannot make taxable supplies, issue tax invoices or claim refunds while it is suspended. The officer should accept the application within 30 days in a Form REG-19 order, and the effective date cannot be earlier than the date you applied. Where something is missing, the officer writes to you and you get seven working days to reply.
Returns for periods up to your application date are still due, so file them and pay any tax first. The guide to GST return filing for freelancers lists what is due.
Your final return GSTR-10 is due within three months of the cancellation
The final return, GSTR-10, is due within three months of the date of cancellation or the date of the cancellation order, whichever is later. It does not apply to composition taxpayers, so a freelancer on the composition scheme files no GSTR-10. A nil GSTR-10 is allowed if you owe nothing. After the order exists, the link appears on the portal under Returns, and you sign with a DSC or EVC. If you do not file, the officer can send a notice and then assess your tax on best judgment, and a late fee applies, so check the portal for the current fee instead of counting on a waiver.
Cancellation does not wipe the past. Section 29(3) says liability for tax and dues for periods before cancellation continues, whether it is found before or after. Keep your invoices and returns, because an old period can still come up. The same applies if the registration is closed because a freelancer has died, a case covered in the guide on succession planning for freelancers.
Input tax credit reversal covers goods in stock and capital goods, not services
On cancellation, Section 29(5) requires you to pay an amount equal to the higher of two things: the input tax credit on inputs held in stock and capital goods, or the output tax on those goods. For a service freelancer the real exposure is capital goods on which you took credit, such as a laptop or camera. The rules reduce the credit for the months of the five-year life already used, so an older laptop costs you less than a new one. Credit on services and expenses you have already consumed is not reversed under this section.
You can pay the amount from your electronic credit ledger or in cash when you file the final return. If you never claimed credit on goods, you may owe nothing, but state your stock and capital goods honestly on the application.
Stopping without cancelling leads to late fees, and the department can cancel for you
If you stop filing instead of cancelling, the late fees and interest keep building. The department can also cancel the registration on its own, and tax commentary puts the trigger at six continuous months of missed returns for monthly filers and two tax periods for quarterly filers. A registration cancelled this way can be revived by applying for revocation in Form REG-21 within 90 days of the order, which senior officers can extend on cause, and the pending returns must be filed first.
Rules for cancellation and revocation have been revised before, so check the portal for the current process. If your turnover later rises above the threshold, you must register afresh. Once your registration is cancelled you are no longer registered, so you should not charge or collect GST on invoices.
Keep invoices correct on the way out
Rinto creates GST-ready invoices with automatic IGST, CGST and SGST calculation, so your tax invoices stay correct until the cancellation takes effect. It does not file returns or cancel your registration, which you do on the GST portal or through your CA. The guide to GST invoices for freelancers shows what a compliant invoice contains. This post is general information, not tax advice.
Frequently Asked Questions
How do I cancel my GST registration as a freelancer?
Log in to the GST portal and file Form REG-16, the application for cancellation of registration, within 30 days of the event that justifies it. You give the reason, the date from which you want cancellation, the value of any stock and capital goods, and the details of your last return. The officer should act within 30 days by issuing a Form REG-19 order. After the order, file the final return, GSTR-10, within three months of the later of the cancellation date or the order date. Returns for periods up to your application date are still due, so file them first.
Can I cancel a voluntary GST registration?
Yes. Since 1 January 2021, Section 29(1) of the CGST Act allows a person who registered voluntarily to opt out. An older rule that stopped voluntary registrants from applying within a year of registering was later omitted, so there is no lock-in in the current rules. You still file Form REG-16 with a reason, such as staying below the ₹20 lakh threshold, and returns for periods up to your application date are still due, with any tax paid. Check the portal for your state's current process before you apply.
What is GSTR-10 and when is it due?
GSTR-10 is the final return a taxpayer files after the GST registration is cancelled. It is due within three months of the date of cancellation or the date of the cancellation order, whichever is later. It reports the stock and capital goods held and the tax paid on them. A nil GSTR-10 is allowed if you owe nothing, and composition taxpayers do not file it. If you miss the date, the officer can send a notice and then assess you on best judgment, and a late fee applies, so check the portal for the current fee.
Do I have to reverse input tax credit when I cancel GST?
You reverse credit only on inputs held in stock and on capital goods, such as a laptop or camera, as Section 29(5) of the CGST Act sets out. You pay the higher of the credit on those goods or the output tax on them, and the credit on capital goods reduces for the months already used. Credit on services and expenses already consumed is not reversed under this section. You can pay from your credit ledger or in cash when you file the final return, so state your stock and capital goods honestly on the application.
What happens if I stop filing GST returns instead of cancelling?
Late fees and interest keep building for every missed return. The department can also cancel the registration itself, and tax commentary puts the trigger at six continuous months of missed returns for monthly filers and two tax periods for quarterly filers. To revive a cancelled registration, apply for revocation in Form REG-21 within 90 days of the cancellation order, a period senior officers can extend on cause, and file all pending returns first. It is far cheaper to cancel properly than to let the registration lapse.
